Why do I need a whistleblower system?
In implementing the European Union's ‘EU Whistleblower Directive’, German lawmakers have required companies in Germany to set up an internal whistleblower system. These requirements apply to all companies with more than 50 employees.
Regardless of the number of employees, all companies in the financial and insurance sectors, such as investment service providers or capital management companies, must also have appropriate whistleblower systems in place.
Appointment of an ombudsperson
In addition to the whistleblower system, companies must also appoint an ombudsperson who reviews incoming reports and ensures that they are handled properly.
The legal requirements stipulate that reports to the ombudsperson must be treated confidentially. Companies are therefore well advised to have an appropriate technical solution in place in the form of a whistleblower system.
